TERMS AND CONDITIONS

By using the Alerto Pinoy mobile application (henceforth called the “APP”), you agree to the following terms and conditions. Vibal Group, Inc. (henceforth called the “DEVELOPER”) has the right to change the terms stated here in future iterations.

  1. Any content you contribute to the APP—including but not limited to status updates, locations, and the like—will be used by the DEVELOPER to determine the extent of post-calamity damages and to inform authorities about users that need immediate help.
  2. Through the Alerto Share function, posts on the APP can be linked to Facebook and Twitter. However, the two aforementioned social networks have their own respective privacy policies and license agreements which may have a different set of terms. Therefore, this agreement will not supersede the policies of the mentioned social networking platforms.
  3. Any content you contribute to the APP is done in good faith, and will be seen by other users who utilize the service.
  4. Any and all definitions bundled in the APP are obtained from verified sources, properly cited, and approved by the Department of Science and Technology (DOST), Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA); National Disaster Risk Reduction and Management Council (NDRRMC) and National Solid Waste Management Council (NSWMC). Therefore, all terminologies in the APP are strictly meant for informative purposes only and cannot be used for commercial endeavors.
  5. Any and all content you submit to the APP can be deleted anytime. However, our servers will retain back-up copies of your data for a certain period. This cannot be accessed by the public, and will be primarily used by the DEVELOPER for improving the APP’s functionality and assessing post-calamity situations.
  6. The DEVELOPER reserves the right to refuse service to users, cancel user accounts, or limit user access to the APP in case its functionalities are abused.
  7. The DEVELOPER also has the prerogative to take legal action against deliberate misuse of the APP with malicious intent, including but not limited to mislead and misinform authorities that are engaged in rescue missions for possible victims of calamities.
  8. Any and all content provided by users will be used solely to improve the app in its task of delivering timely updates about disasters and calamities. Therefore, the DEVELOPER will treat the content contributed by users with utmost confidentiality.
  9. Ownership and intellectual property rights in and to the APP shall remain with the DEVELOPER, in perpetuity.
  10. The DEVELOPER will not be liable for damages that may arise from the use of or inability to use the APP, any of its contents, or from any action taken as a result of its use or non-use.
  11. You acknowledge that you have read this license agreement, understand it, and agree to be bound by its terms and conditions. You further agree that it is the complete and exclusive statement of the license agreement between you and the DEVELOPER. Thus, this agreement supersedes any proposal or prior agreement—oral or written—and any other communications between you and the DEVELOPER relating to the subject matter of this license agreement.

  • Any content a user adds or any changes that he or she makes to Alerto Pinoy will be publicly and permanently available.

  • Your Public Contributions: Whatever users post on Alerto Pinoy can be seen and used by everyone.
  • Account Information & Registration: If users create an account, they do not need to give Alerto Pinoy their real names.
  • Information Related to Your Use of the Alerto Pinoy App: Alerto Pinoy may use common technologies to collect information about how users use this app.

We use this information to enhance user experience and to develop new features.

  • Information We Receive Automatically: Like other apps, Alerto Pinoy receives some information about a user automatically when he or she downloads the Alerto Pinoy App. This information helps us administer the app and enhance user experience.

  • We may share a user’s information when he or she gives us specific permission to do so.
  • We will disclose a user’s information in response to an official legal process only if we believe it to be legally valid. We will notify a user of such requests when possible.

    • Enforce or investigate potential violations of community-based policies;
    • Protect our organization, infrastructure, employees, contractors, or the public; or
    • Prevent imminent or serious bodily harm or death to a person.

We may disclose personal information to our third-party service providers or contractors to help run or improve the app and provide services in support of our mission.

We may give volunteer developers and researchers access to systems that contain a users’ information to allow them to protect, develop, and contribute to the Alerto Pinoy App.

We may also share non-personal or aggregated information with third parties interested in studying the Alerto Pinoy App.

When we share information with third parties for these purposes, we put reasonable technical and contractual protections in place to protect users’ information consistent with this Policy.

The information that users post are public and can been seen and used by everyone.

We use a variety of physical and technical measures, policies, and procedures to help protect users’ information from unauthorized access, use, or disclosure.

We only keep users’ personal information as long as necessary to maintain, understand, and improve the Alerto Pinoy App or to comply with the law.
